Terms of service

1. General Provisions



1.1. The online store Aura Bricks (“the Store”) sells construction bricks and accessories (“Products”).

1.2. These Terms of Service (“Terms”) define the rules for: (i) using the Store, (ii) concluding sales contracts between the Store and the Customer, and (iii) the rights and obligations of both parties.

1.3. By placing an order, the Customer confirms that they have read, understood, and accepted these Terms in full before making a purchase.



2. Offer and Contract Formation



2.1. The presentation of Products in the Store constitutes an invitation to make an offer, in accordance with Article 71 of the Polish Civil Code.

2.2. Customers place orders via the Store’s online order form, selecting the Product, payment method, and delivery option.

2.3. The contract of sale is concluded when the Store sends an email confirming that the order has been accepted (“Order Confirmation”).

2.4. All prices are shown in Polish zloty (PLN) and include VAT unless stated otherwise. Delivery costs are listed separately.



3. Payment and Delivery



3.1. Payments can be made using the methods available in the Store (e.g., bank transfer, credit/debit card, online payment systems).

3.2. Once payment is received, the Store begins processing the order.

3.3. Products are delivered to the address provided by the Customer in the order form. Delivery times are approximate. The Store will make every effort to deliver orders promptly, but these times are not guaranteed — delays due to external factors (e.g., courier delays, force majeure) are possible.

3.4. In case of delays exceeding [specified number] days, the Customer is entitled to consumer rights under applicable law, including the right to withdraw from the contract or request a price reduction.



4. Right of Withdrawal (Consumers)



4.1. If the Customer is a consumer (as defined under Polish consumer protection law), they have the right to withdraw from the contract within 14 days without giving any reason and without incurring costs, except as described below.

4.2. The 14-day withdrawal period begins:


  • for a single Product – on the day the Customer receives the item,
  • for multiple Products delivered separately – on the day the Customer receives the last item.
    4.3. To exercise the right of withdrawal, the Customer must notify the Store of their decision by sending a clear statement (e.g., via email).
    4.4. The Customer must return the Product within 14 days from the date of withdrawal notice. The Customer bears the direct cost of returning the item unless the Store offers free returns. Returned Products must be in their original condition, except where necessary to establish their nature, characteristics, or functioning.
    4.5. The Store will refund all payments received from the Customer, including delivery costs (unless the Customer chose a more expensive delivery option), within 14 days of receiving the withdrawal notice. Refunds will be made using the same payment method unless the Customer agrees otherwise and no extra fees apply.




5. Warranty and Complaints



5.1. Consumer sales are subject to statutory warranty rights under the Polish Civil Code and, if applicable, any manufacturer’s guarantee.

5.2. The Customer may file a complaint if the Product has a physical or legal defect. The complaint should include a description of the defect and proof of purchase.

5.3. The warranty period lasts two years from the date the Product was delivered, unless a longer period applies under the manufacturer’s warranty or specific laws.

5.4. Once a complaint is accepted, the Store may request the return of the defective Product. The Store will reimburse the Customer for shipping costs if the defect is confirmed.

5.5. The Store is not liable for damage caused by improper use of the Product (e.g., incorrect assembly, modifications, or exposure to unsuitable conditions).



6. Limitation of Liability



6.1. The Store is not responsible for delays or non-performance resulting from force majeure or third-party courier failures, provided they are beyond the Store’s control.

6.2. To the extent permitted by law, the Store’s liability for non-performance or improper performance of a contract is limited to the value of the ordered Product.

6.3. Nothing in these Terms limits consumer rights that cannot be excluded or restricted by law.



7. Intellectual Property



7.1. All trademarks, product names, graphics, descriptions, and other materials displayed on the Store’s website are the property of the Store or their respective owners and are protected by law.

7.2. Customers may not copy, distribute, or use any content from the Store in a manner that infringes on intellectual property rights or violates the law.



8. Final Provisions



8.1. The Store reserves the right to amend these Terms at any time. Changes will not affect previously concluded contracts.

8.2. Matters not covered by these Terms are governed by Polish law, particularly the Civil Code and the Consumer Rights Act.

8.3. Any disputes involving a consumer will be resolved by the competent common court in accordance with applicable law.

8.4. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
